Privacy Notice for Certain California Residents
This “Privacy Notice” describes how Bailard, Inc. and its affiliated companies (collectively, “Bailard”, “we”, “us”, “our”) collect, view, access, store, alter, use, disclose, or destroy (hereinafter, “process”) (hereinafter, “process”) personal information about you.
This privacy notice is directed toward California residents who do not fall under any of the following categories: (a) a current Bailard client, (b) a Bailard Real Estate Fund investor, or (c) individuals whose personal information is covered under the federal Gramm-Leach-Bliley Act. [1]
Personal Information We Collect
Depending on the circumstances of our relationship with you, the categories of personal information Bailard may collect and process includes, but is not limited to:
- Basic Personal Information, such as name, email address, postal address and phone number
Note: No mobile/cell phone/telephone number information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. - Identifiers, such as social security number
- Financial details, such as income and net worth
- Employment information
- Inferences drawn from other personal information, such as profile information reflecting your preferences, characteristics, predispositions and behavior.
Methods of Collection
Collection of personal information may take place directly through our interactions with you or through third parties such as individuals or institutions providing referrals.
Purposes of Processing
Bailard may collect and process personal information for the following purposes:
- To deliver content, as well as product and service offerings.
- To create, maintain, customize and secure your account with us.
- To communicate with you, provide support or respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
- For research, analysis, and product development, including to develop and improve our products, and services.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
Transfers of Personal Information
Bailard may transfer personal information to third parties including, but not limited to:
- Subsidiaries and Corporate Affiliates
- Service Providers
- Professional Advisors
No mobile/cell phone/telephone number information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Bailard may transfer your personal information, in connection with an actual or proposed business deal such as a merger, consolidation, acquisition or in the event of bankruptcy.
Bailard may be required to share personal information with public authorities or to comply with applicable laws, regulations or court orders. We may share your personal information if disclosure is necessary to protect and defend Bailard’s, your, or other parties’ rights or interests.
Retention of Personal Information
We will retain your personal information for at least as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying legal, accounting, or reporting requirements.
Your Rights
The California Consumer Privacy Act (“CCPA”) provides California residents with specific rights regarding their personal information. If you reside in California, you or your authorized agent may request that we take the following actions in relation to your personal information:
- Access: Disclose to you the categories and specific pieces of personal information that we have collected, used or disclosed within the last 12 months, including personal information (if any) that we disclosed to third parties for direct marketing purposes.
- Transfer: Transfer an electronic machine-readable copy of your personal information to you.
- Deletion: Delete your personal information.

We will request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions.
